The suit in restitution is available to Brianna only if the court holds that Brian materially breached; then she must show (1) that her services conferred a $60,000 benefit on Brian, and (2) it is unjust to let Brian retain that benefit. If she succeeds in establishing (1) and (2), she will recover the $60,000, much more than her expectation damages of $0. This calculation is illustrated on the next screen.
Note that, in the restitution recovery, the court will not subtract the $42,000 salary Brianna earned at her new job. There is no provision for that. The focus of the restitution recovery is entirely on the value of her services to Brian.
