Ruth is an intermediary between small toy stores and suppliers of a variety of different sorts of toys. She sends a written offer to purchase one hundred hula hoops to HoopLA, a hula hoop manufacture in Los Angeles.

HoopLA does not respond to Ruth's order, and they do not fill it. When Ruth asks why, they claim that, since they did not respond, they never accepted it.

Ruth has dealt with HoopLA for five years, during which time she has sent in written order and HoopLA has filled them without any further communication. She expected HoopLA to fill the order for the hula hoops.
