Restatement §201(2)

Restatement §201(1) concerns situations in which the parties attach the same meaning to a term.

Restatement §201(2) deals with those cases in which the parties attach different meanings. This is what happens in Embry v. McKittrick, analyzed in the previous tutorial.

We first review Embry v. McKittrick and then apply §201(2).

As with §201(1), §201(2) is not a rule distinct from the Objective Intent Test, but a summary of the results of applying that rule in a particular context.
