Since the buyer has more than enough conforming plywood for its construction purposes, the non-conformity in the first carload of plywood arguably does not substantially impair the value of the installment. Consequently, the buyer has no right to reject the installment. Note: even though the buyer has no right to reject the installment, the delivery of the non-conforming plywood is still a breach, and the buyer will be entitled to damages for losses the breach causes.
